The UK’s bar and restaurant workers now have good cause to celebrate.
An employment tribunal ruled in HMRC’s favour by supporting current National Minimum Wage legislation relating to tips.
The decision in the case of a restaurant now means that an employer has to pay its staff at least the National Minimum Wage regardless of any tips, service charges or gratuities so long as these are not paid directly through the payroll.
HMRC have been especially keen to implement the National Minimum Wage legislation over recent months whilst the number of cases reaching the courts has been increasing.
Herminder Sandhu of Regional Business Advisers Cooper Parry says, “It’s a good idea to remind ourselves of our obligations in respect of the National Minimum Wage legislation. Briefly the current rates are £5.52 per hour for workers 22 and over, £4.60 for workers between 18 and 21 and £3.40 for workers under 18.”
